Pursuant to Article 73, paragraph 4 of the Waste Management Law ("Official Gazette of RM" No. 80/05, 73/08), the Government of Montenegro at the session on 25 December 2008 adopted the Regulation on the criteria, amount and manner of payment of special fees for waste management ("Official Gazette of Montenegro, No.11/09, 16 February 2009), and at the session on 18 June 2009, the Government issued the Regulation on Amendments to the above mentioned Regulation on waste management ( "Official Gazette of RM, No. 46/09, 22 July 2009).
Above stated Regulations define the obligations of waste producers and importers. In addition, Article 73, paragraph 2 of the Waste Management Law (“Official Gazette of RM" No. 80/05, 73/08) specifies who and for which products pays a special fee for waste management, and the adoption of bylaws is underway, which will define precisely this issue.

 In accordance with Article 7 of the Regulation on the criteria, amount and manner of payment of special fees for waste management (Official Gazette of Montenegro ", no. 11/09 and 46/09), manufacturers and importers, to whom this Regulation applies, are obliged to report the activity to the Environmental Protection Agency in the form of "Application-Board" - Appendix 3 (in 2 copies) and all subsequent changes.

Fee payers from this Regulation are obliged, pursuant to Article 5, to make the quarterly fee calculation and submit it to the Customs Administration of Montenegro on the quarterly basis in the form "Calculation-UO”.
Special fee payers must report their activities to the Agency no later than:

- 1 October 2009 for the packaging that is not intended for packaging of goods,
- 1 January 2010 for other products and other packaging from Annex 1, Regulation.
Obligation of fee billing and payment exists from:
- 1 January 2010 for the packaging, which is not intended for packaging of goods,
 -1 January 2011th other products and other packaging from Appendix 1 Regulation.
