     Regulation on Projects for which Environmental Impact Assessment is Performed

    

     INITIATION OF PROCEEDINGS
 

     Phase I Decision making process with regard to the EIA necessity  


Based on Article 10 paragraph 3 of the Law on Environmental Impact Assessment
("Official Gazette of the RMNE", no.80/05), the Ministry of Tourism and Environmental Protection adopts

 The Rulebook on contents of the documentation which is submitted with the application for deciding about the need for EIA ("Official Gazette of MNE", no.14/07 from 21/12/2007)

The contents of the documentation that is submitted by a project holder with the application for deciding about the need for EIA are regulated by this Rulebook.

Projects for which EIA may be required are established in the List II of the Regulation on projects for which EIA is performed.


    Phase II the process of defining the scope and contents of the EIA Study


Based on Article 15 paragraph 3 of the Law on Environmental Impact Assessment ("Official Gazette of the RMNE", no.80/05), the Ministry of Tourism and Environmental Protection adopts:

The Rulebook on the contents of the documentation which is submitted with the application for defining the scope and contents of the EIA Study

("Official Gazette of MNE", no.14/07 from 21/12/2007)

The Rulebook prescribes the contents of the documentation that the project holder submits with the application for defining the scope and contents of the EIA Study.
Pursuant to Article 15 paragraph 1 of the EIA Law, the project holder can submit the application for defining the scope and contents.

Phase III the Procedure with regard to the EIA Study approval

Pursuant to Article 17 of the EIA Law, the project holder submits the application to a competent body for the Study approval.

With the application from paragraph 1 of this Article, the project holder submits the Study.

If the competent body has been defining the scope and contents of the Study, the project holder is required to submit the application to the competent body for approval, the latest within a year from the day of receiving final decision about the Study scope and contents. 

If the project holder from paragraph 3 of this Article applies for approval after the scheduled deadline, the competent body will decide on the submitted request depending on the circumstances of an individual case. 
Based on Article 18 paragraph 6 of the Law on EIA ("Official Gazette of the RMNE", no.80/05),

the Ministry of Tourism and Environmental Protection adopts

The Rulebook on the EIA Study contents

("Official Gazette of MNE", no.14/07 from 21/12/2007)

This rulebook regulates the EIA Study contents more closely.
