SEA Permits for Strategic Environmental Impact Assessment

The law on strategic environmental impact assessment (Official Gazette of the RM, no. 80/05) came into force on 1 January 2008. This law establishes the conditions, manner and procedure of   assessment of certain plans or programs impact on the environment, by integrating principles of environmental protection in the drafting, adoption and implementation of plans or programs that have an impact on the environment.

A short description of the procedure concerning the issue of consent to the Study on the Environment

- Pursuant to Article 17 of the Strategic Impact Assessment Law, a report on strategic assessment is submitted to the Environmental Protection Agency to be appraised;

- Environmental Protection Agency gives notes or suggestions about the given report after which it is returned to final processing and forwarded for further procedure;
 
- The legal deadline for giving opinions on the report on the strategic impact assessment is 30 days from submission of the report for consideration;

- It is considered that the Environmental Protection Agency has no objections unless the opinion is given within the time provided by law;

- After the expiration date, a plan or program processor is required to inform the public and organize a public hearing for allocating the strategic impact assessment report to the public for consideration.

- After the public hearing the Environmental Protection Agency establishes an expert committee to review the complete report again;

- The final step in this process is the issue of consent to the given report, which is performed by the previously formed expert committee.
